This necessitates the establishment of a transparent and effective process for identifying, assessing and monitoring risks, commonly referred to as a risk-based compliance monitoring program. In this context, the objective is to gain insight into prevailing market practices and developing a suitable conceptual framework, with specific focus on compliance risk assessment and monitoring activities. Member participation from the financial sector, affiliated with banks, investment firms and management companies, who specialise in compliance and responsible for overseeing compliance monitoring activities, supports us in gaining an understanding of the various existing frameworks within the financial industry, discuss and propose a paper that explores the key trends and future perspective of a robust framework, and collaborate in defining a common conceptual compliance framework for risk assessment and monitoring activities. Après près de 5 ans d’intégration du cadre juridique du RGPD et de ses exigences, une nouvelle étape commence avec la mise en place d’un schéma de certification de la conformité des activités de traitement, tél que prévu par les articles 42 et 43 du RGPD. En février 2023, HACA PARTNERS est devenu le 2ème organisme certificateur accrédité par la CNPD, grâce à une collaboration avec Seralys pour la partie sécurité informatique et avec l’étude DSM Avocats à la Cour pour toutes les questions juridiques. En quoi cette certification peut-elle être utile aux organisations ? Quel est le processus et les efforts nécessaires pour obtenir la certification avec HACA PARTNERS et DSM Avocats à la Cour ? Questions / réponses Intervenants : Me Renaud LE SQUEREN , Associé chez DSM Avocats à la Cour, a plus de 20 ans d’expérience en droit du numérique. Entre 2005 et 2008, il a travaillé comme consultant externe pour la CNPD. Depuis 2014, il est en charge du pôle Digital chez DSM Avocats à la Cour et accompagne ses clients dans leur transition numérique (RGPD, plateformes, e-commerce, APIs, Apps…). En parallèle, Renaud s’implique dans le tissu local par sa participation en tant qu’administrateur dans plusieurs associations telles qu’eCom et l’APDL. M. Cédric LEROY, réviseur d’entreprises et Head of Regulatory & Compliance chez HACA PARTNERS, possède une expérience de 15 ans en matière d’audit et de fiscalité dans le secteur de la gestion d’actifs au service d’importants promoteurs de fonds d’investissement. Cédric a développé une expertise spécifique relative tant à l’efficacité opérationnelle de l’approche d’audit par l’utilisation de nouveaux outils informatiques qu’à l’organisation interne des cabinets d’audit et de conseil. M. Alain HERRMANN est fonctionnaire auprès de la CNPD depuis 2012. Il y a débuté en tant qu’expert en informatique et nouvelles technologies pour évoluer jusqu’au poste de chef du service Conformité. Depuis Septembre 2021, il est Commissaire à la protection des données auprès de la CNPD.
